Children to pay parents’ maintenance – High Court

Bhopal/Jabalpur: The Madhya Pradesh High Court has rejected a petition filed by a person who wanted to challenge the order of the Executive Magistrate to share the maintenance amount with his three brothers. The person, Govind Lodhi, claimed that his mother had given her property to his three brothers, but not to him.

The court said that whether or not children get a share of their parents’ property, it is their duty to take care of their parents. Justice G S Ahluwalia rejected the petition, saying that it’s a moral responsibility to take care of parents, regardless of what they receive from them or not.

Govind Lodhi’s mother had filed an application for maintenance under the Maintenance Welfare of Parents and Senior Citizens Act, 2007. The court ordered each of the four sons to pay Rs 4,000 per month towards maintenance. Govind Lodhi appealed against this order and claimed that his mother had promised to take care of him and therefore she gave her property to his three brothers. He also said that his mother didn’t give him any property, including an 8-acre land in her name.

However, the court said that if Govind Lodhi is not happy with the decision, he can file a separate civil suit to get a share of the land. But he cannot escape the responsibility to pay for his mother’s maintenance.”
